Lovells advises on a range of contentious technology matters, in particular disputes where the technologies involved are novel and/or complex. We regularly advise clients on contractual disputes involving development projects, joint ventures, system supply, software licensing and outsourcing. We have experience of advising in connection with criminal prosecutions (such as under the U.K Computer Misuse Act) and in connection with disputes involving encryption and security products. We also have particular experience in relation to cross-border and international disputes including those arising as a result of web-based transactions.
Other examples of our work in this field include disputes concerning privacy and data protection, online gaming, internet domain names and the intellectual property aspects of technology.
The great majority of disputes relating to technology are resolved by negotiation. If that does not succeed, then a significant proportion of the remainder are resolved by mediation, which is particularly appropriate for complex technical matters. Lovells has a strong mediation practice and has been involved in many substantial mediations in the technology field.
