Given the commercial sensitivities involved in procurement disputes, most cases do not enter the public domain. Set out below are certain recent and publicly known matters in which we have been involved.

  • Galileo. Advising the Galileo Joint Undertaking on procurement issues arising in the context of the concession for a global satellite navigation system

  • Tideland Signal. Successfully challenging a European Commission tender procedure before the European Court of First Instance

  • Tube Lines. Advising a successful bidder in the London Underground PPP on procurement, State aid and merger control issues

  • Berlin airport. Litigation before the German courts on behalf of one of the two bidders for the contract to build and operate the new Berlin airport. The bidding group was restored to the tendering process

  • Royal Mail. Advising inter alia, on procurement aspects of the £1.5 billion IT outsourcing to CSC

  • a wide range of projects under the UK Private Finance Initiative and Public Private Partnerships in general. We have for some years been at the forefront in considering the application of the procurement rules to such projects, which are becoming increasingly common in other Member States.
