Synopsis

Tackling overseas bribery and corruption has become a key focus for prosecuting authorities around the world.  Over recent years the US, in particular, has been proactive in combating corruption of government officials abroad by vigorously enforcing the Foreign Corrupt Practices Act ("FCPA").  The FCPA criminalises (amongst other things) certain acts of overseas bribery anywhere in the world if carried out by US companies or companies who simply do business in the US.  Indeed, European corporates are more likely to face corruption charges from the US than from their "home" authorities.

Despite a number of high profile cases in the last 12 months - Siemens could be fined several billion euros - a surprising number of European corporates have not yet focused on the international risks which need to be managed in this area.

Against this backdrop, the seminar will focus on how your company may be exposed to the anti-corruption regime and how such risk can be managed, including discussion of:

  • the key elements of bribery offences under US and legislation;
  • some compliance basics;
  • internal investigations; and
  • FCPA/bribery issues arising out of corporate transactions.
